These Terms of Use (“Terms of Use”) apply to the Public Health Foundation of India’s Centre for Tobacco Control and Health Promotion (here after called as “PHFI-CTCHP” unless expressed explicitly) web site. Please review these Terms of Use carefully before using this Web site. Use of this Web site, www.ctchp.org and all pages in this domain (together, the "PHFI-CTCHP Web Site"), constitutes acceptance of the following terms and conditions. PHFI-CTCHP reserves the right to seek all remedies available by law for any violation of these terms of use, including any violation of PHFI-CTCHP's rights in the PHFI-CTCHP’s name and logo and its rights in connection with the information, artwork, text, video, audio, or pictures (together, the "Content") of the PHFI-CTCHP Web Site.

PHFI-CTCHP reserves the right to deny service to any person if PHFI-CTCHP determines that such person has violated these Terms of Use, or for any reason poses a threat to the smooth functioning of this Web site for the benefit of the Public Health Foundation of India and its community.

1.    The PHFI-CTCHP Name and Logo

The PHFI-CTCHP name and logo are the exclusive property of PHFI-CTCHP. They are protected under the prevalent law. Unauthorized use is prohibited. They may not be copied or reproduced in any way without the prior written permission of PHFI-CTCHP. Requests for permission should be sent to us in “Contact us” form.

2.    The PHFI-CTCHP Web Site

The PHFI-CTCHP Web Site is provided by PHFI-CTCHP for personal use and non commercial use. It is meant for public good and to be used in good faith only. Any other use, including reproduction or translation of anything more than a de minimis portion of the Content of the PHFI-CTCHP Web Site or any use other than for personal or educational purposes, requires the express prior written permission of PHFI-CTCHP. Requests for permission should be sent to us using the copyright permission option on our “Contact us” form, specifying full details of the proposed use. All Content of the PHFI-CTCHP Web Site is protected by law including, as applicable, copyright laws.
The Content of the PHFI-CTCHP Web Site is taken on the basis of PHFI-CTCHP's own criteria and in its own sole discretion. PHFI-CTCHP reserves the right at any time to change or discontinue any aspect or feature of the PHFI-CTCHP Web Site, including but not limited to these terms of use, hours of availability and equipment needed for use.

3.     Proper Use of Web Site

You agree that you are responsible for your own use of the Web site, for any posts you make, for any content you upload, and for any consequences thereof. You agree that you will use the Web site in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. Violation of any of the foregoing may result in immediate termination of these Terms of Use and may subject you to state and federal penalties and other legal consequences.

We reserve the right, but shall have no obligation, to investigate your use of the Web site in order to:

(a) Determine whether a violation of these Terms of Use has occurred or
(b) Comply with any applicable law, regulation, legal process or governmental request.

Public Health Foundation of India reserves the right to modify, reject, or eliminate any information residing on or transmitted to this Web site that, in its sole discretion, it believes is unacceptable or in violation of these Terms of Use.

4.    Intellectual Property Rights

You may use the Web site and the Content offered on the Web site only for personal, non-commercial purposes. You may not modify, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way exploit the Content of this Web site or any portion of it. You may use Content offered for downloading, for personal use only and subject to any rules that accompany that particular Content. In the event of any permitted copying, redistribution or publication of material from the Web site, no changes in or deletion of author attribution, trademark, legend or copyright notice shall be made by you.

You may not use the Content in a manner that exceeds the rights granted for your use of the Content. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.

5.    Other Web Sites

The PHFI-CTCHP Web Site may be linked to other web sites that are not under PHFI-CTCHP's control. PHFI-CTCHP provides these links merely as a convenience and the inclusion of such links does not imply an endorsement or approval by PHFI-CTCHP of any web site, product or service. PHFI-CTCHP does not assume any responsibility or liability in respect of such web sites, including, for example, responsibility or liability for the accuracy or reliability of any information, data, opinions, advice or statements made on those web sites.

6.    Working Papers/Documents

The PHFI-CTCHP Web Site may contain Working Papers, documents or discussion drafts of PHFI-CTCHP Policy Papers. Comments and responses are welcome, but these should in all cases be addressed directly to PHFI-CTCHP and not uploaded to the PHFI-CTCHP Web Site. These documents are provided by PHFI-CTCHP as a contribution to discussion on important issues affecting issues affecting PHFI-CTCHP, and to assist PHFI-CTCHP by broadening and deepening the range of the consultations engaged in by the PHFI-CTCHP. Such documents do not represent the PHFI-CTCHP’s definitive position on the issues covered and are not to be represented as such. Working papers may not be quoted or otherwise used outside the PHFI-CTCHP Web Site.

7.    Interactive Parts of the PHFI-CTCHP Web Site

The PHFI-CTCHP Web Site may contain bulletin boards, access to mailing lists or other message or communication facilities. The user agrees, when taking advantage of such facilities, not to do any of the following: (a) defame, abuse, harass, stalk, threaten or otherwise violate the legal, moral, or human rights of others (such as rights of privacy and publicity); (b) publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information; (c) upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy) unless the user owns or controls the rights thereto or has received all necessary consents; (d) upload or attach files that contain viruses, corrupted files, or any other similar software or programmes that may damage the operation of another's computer; (e) delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded; (f) falsify the origin or source of software or other material contained in a file that is uploaded; (g) advertise or offer to sell any goods or services, or conduct or forward surveys, contests, or chain letters; (h) download any file posted by another user that the user knows, or reasonably should know, cannot be legally distributed in such manner (i) encourage conduct that would constitute a criminal offense, or that gives rise to liability; (j) use a member name or e-mail of another person with the intention of impersonating that person; (k) use a member name or e-mail address of anyone else without authorization; (l) use a member name in violation of the intellectual property rights of any person or(m) use a member name that we consider to be offensive.

PHFI-CTCHP reserves the absolute right to delete any material posted to the PHFI-CTCHP Web Site without notice to the user.

8.     Monitoring

Public Health Foundation of India shall have the right, but not the obligation, to monitor the content of the Web site to determine compliance with these Terms of Use and any other operating rules that may be established by us from time to time. Public Health Foundation of India shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on the Web site. Without limiting the foregoing, we shall have the right, but not the obligation, to remove any material that we, in our sole discretion, find to be in violation of the provisions hereof, otherwise objectionable or stale. Notwithstanding this right of ours, users shall remain solely responsible for the content of their messages. You acknowledge and agree that neither us nor any of our affiliates shall assume or have any liability for any action or inaction by us with respect to any conduct within the Web site or any communication or posting on the Web site.

9.    Privacy policy

Your privacy on the Internet is of utmost importance to the Public Health Foundation of India (PHFI-CTCHP).  This privacy statement describes PHFI-CTCHP’s policy concerning the gathering and sharing of visitors’ information through the PHFI-CTCHP web site.  

9.1 Normal website usage
In general, you can browse the PHFI-CTCHP Web site without telling us who you are or revealing any personal information about yourself.

9.2 Collection of personally identifiable information
If you register for a newsletter, request information, provide feedback, apply for a job, join a discussion group or join an electronic mailing list, you will be asked to provide personal information such as your name, postal address and e-mail address.  This information is collected only with your knowledge and permission, and is kept in a database.

9.3 Personally identifiable information
PHFI-CTCHP may use the personal information you provide to:
1) Contact you – either in response to a query or suggestion, or to mail newsletters, documents, publications, etc. to you.
2) Manage and process your job application;
3) “Remember” your online profile and preferences;
4) Help you quickly find information that is relevant to you based on your interests, and help us create site contents most relevant to you;
5) Undertake statistical analysis.

9.4 What if I don’t want to provide personal information?
Providing personal information on the PHFI-CTCHP web site is optional.  If you choose not to provide personal information, you can still browse and use the PHFI-CTCHP Website, but you will not be able to carry out certain actions such as registering for a newsletter, or applying for a job.

9.5 Security
We do not sell or share any personally identifiable information volunteered on the PHFI-CTCHP site to any third party without prior consent.  Any information provided to PHFI-CTCHP by users of the PHFI-CTCHP site is held with the utmost care, and will not be used in ways other than as set forth in this privacy policy, or in any site-specific policies, or in ways to which you have explicitly consented.  

PHFI-CTCHP assumes no responsibility for the security of information.

The PHFI-CTCHP site may contain link to sites external to the www.ctchp.org domain.  PHFI-CTCHP is not responsible for the privacy practices or the content of such sites.

Changes to this privacy policy will be posted here and will be available via the PHFI-CTCHP home page at http://www.ctchp.org.
